IP SERVICE INTERNATIONAL secures five-figure settlement in international baby products trade mark dispute through targeted Shopify and Amazon takedown requests

IP SERVICE INTERNATIONAL acted for an Australian baby-products business in an international trade mark dispute involving a UK-based seller and unauthorised products offered through Shopify and Amazon.

Through a coordinated online enforcement strategy, we secured the removal of the relevant product listings and sales pages. The resulting commercial pressure brought the reseller to the negotiating table and enabled our client to achieve a five-figure financial outcome, recover a contribution towards its legal costs and retain long-term control over its brand.

Background

Our client owns a portfolio of registered trade marks protecting its baby-products brand in Australia, the United Kingdom, the United States and the European Union.

A UK-based reseller subsequently launched a product under branding that conflicted with our client’s registered trade mark rights. The product was promoted and sold through the reseller’s Shopify-powered website and through Amazon.

The unauthorised product created a material risk of consumer confusion and brand dilution. It also had the potential to undermine the commercial value of the international trade mark portfolio our client had invested in developing and maintaining.

The reseller had acquired substantial inventory and had significant quantities of the product remaining in stock.

Our Strategy‍

Our team developed a targeted enforcement strategy designed to stop ongoing sales promptly while preserving our client’s broader commercial options.

We reviewed the relevant trade mark registrations, assessed the online use and compiled evidence of the potentially infringing product listings. We then submitted coordinated intellectual property complaints through the enforcement processes operated by Shopify and Amazon.

The complaints resulted in the relevant online product pages and sales channels being taken down with immediate effect

Removing access to these ecommerce channels materially changed the commercial dynamics of the dispute. With substantial inventory remaining but no practical means of continuing online sales, the reseller approached us to explore a negotiated resolution.

Rather than simply permitting the products to return to the market, we negotiated a structured trade mark licence and settlement arrangement on behalf of our client.

Outcome

The matter was resolved without the need for court proceedings.

Under the negotiated agreement:

  • Our client received a five-figure commercial payment.
  • The payment included agreed trade mark licensing consideration and a contribution towards our client’s legal costs.
  • Our client agreed to withdraw the relevant Shopify and Amazon takedown requests.
  • The reseller received a strictly limited six-month period in which to sell its remaining stock.
  • At the end of the six-month period, the reseller is required to cease all further use of the trade mark permanently.

The resolution allowed our client to convert its registered trade mark rights into a direct commercial return while maintaining control over the long-term use of its brand.

It also provided a commercially pragmatic solution to the remaining inventory issue. The reseller received a defined and non-permanent pathway for disposing of existing stock, while our client avoided the cost, delay and uncertainty associated with international litigation.
