IP SERVICE INTERNATIONAL successfully resolves international design infringement dispute involving French court proceedings

This is some text inside of a div block.

IP SERVICE INTERNATIONAL acted for an Australian business in urgent French court proceedings concerning alleged infringement of European Union design registrations.

The matter required immediate cross-border legal intervention. The client had been served with proceedings before the Paris Judicial Tribunal and faced potential injunctions, disclosure obligations, damages exposure and further enforcement action.

‍Our Strategy‍

The dispute called for specialist international intellectual property expertise, combining an understanding of Australian commercial realities with French court procedure and European design law.

Quentin Dequiret, our French-Australian intellectual property lawyer, was able to assess the client’s position quickly, advise on the procedural and commercial risks, and develop a practical strategy to contain the dispute.

Given the urgency of the proceedings, Quentin travelled to Paris to represent the client directly. This enabled IP SERVICE INTERNATIONAL to engage with the French process in real time, present the client’s position effectively, and support a commercially focused resolution strategy.

Outcome

Following the Paris proceedings, IP SERVICE INTERNATIONAL guided the client through settlement negotiations and worked to avoid further escalation.

The matter was resolved by a full and final settlement, bringing the French proceedings to an end and providing the client with certainty, finality and a clear commercial outcome.

The settlement allowed the client to avoid ongoing litigation, further procedural risk and significant damages exposure.

Key Takeaways‍

International IP disputes can escalate quickly when overseas court proceedings are involved. In urgent cross-border matters, legal strategy is only one part of the solution. Procedural knowlege, commercial awareness and settlement timing can be critical. Specialist international representation can make a decisive difference in managing risk, protecting commercial interests and resolving complex IP disputes efficiently. Excellent service, great result. We initially had issues with our trademark and called them to lodge a declaration to support the mark. Our mark was finally accepted and we believe this was only due to the thorough and detailed documents that were submitted to the trademark office. Great work!
