IP SERVICE INTERNATIONAL successful in multi-jurisdictional design protection project for a novel construction device
The team at IP SERVICE INTERNATIONAL was instructed to protect an industrial design for a novel construction device across Australia, New Zealand, the European Union, Singapore and the United Kingdom, requiring a coordinated and time-critical filing strategy.
Key Issues
A key challenge in this matter was the preparation of design representations capable of being accepted across all target jurisdictions. We arranged for the creation of bespoke CAD drawings, working closely with the client and technical specialists to ensure the representations accurately captured the design while complying with the differing formal and substantive requirements applied by each design office. Particular care was taken to ensure consistency of views, line quality, shading and scope so that the design would be protected without unintended limitations or rejections.
Given the client’s commercial timeline, it was essential that all design applications were filed simultaneously. This avoided reliance on later priority claims and eliminated the risk of intervening disclosures undermining registrability in any jurisdiction. We coordinated the filings to ensure that protection was secured on the same effective date across all markets.
Outcome
The result was an enforceable international design portfolio, providing the client with rubust and actionable protection for its construction device in key global markets. This matter illustrates the importance of front-end planning and technical precision in international design filings, particularly where drawings and timing are critical to the strength of the resulting IP rights.
